Terms of Service
These Terms of Service ("Terms") govern your use of services provided by ProducerPilot, a division of Accelsure LLC ("ProducerPilot", "we", "us"). By engaging our services, you agree to these Terms.

Services
ProducerPilot provides done-for-you digital marketing services for independent insurance agencies and mortgage loan officers, including social media management, SEO content, email campaigns, and Google Business Profile management.

No Guarantee of Results
ProducerPilot and Accelsure LLC make no representations, warranties, or guarantees regarding specific outcomes, results, or performance metrics arising from the use of our services. Digital marketing results — including but not limited to search engine rankings, website traffic, social media engagement, lead generation volume, referral rates, email open rates, and revenue growth — are inherently variable and dependent on numerous factors outside our control, including but not limited to market conditions, competition, platform algorithm changes, client industry, geographic location, and the quality of client-provided materials.

We will make every reasonable effort to deliver services as described in your selected plan. However, we expressly disclaim any guarantee of specific rankings, follower counts, lead volumes, conversion rates, or revenue outcomes. SEO and content marketing results typically require 3–6 months of consistent activity before measurable impact is observed. Past performance of services delivered to other clients does not guarantee similar results for your business.

By using our services, you acknowledge and agree that ProducerPilot and Accelsure LLC shall not be held liable for any failure to achieve specific business outcomes or marketing results.

Subscription and billing
Plans are offered on month-to-month or quarterly terms. Quarterly plans are billed in advance every three months. All fees are non-refundable except as required by law.

Cancellation
Month-to-month plans may be cancelled with 30 days written notice. Quarterly plans may be cancelled at the end of the current quarter with 30 days prior written notice.

Client responsibilities
You are responsible for providing accurate information, approving content before publication when requested, and ensuring any client lists you submit comply with applicable laws (including CAN-SPAM, TCPA, and relevant insurance/mortgage compliance regulations).

Our commitments
We never access your AMS, LOS, CRM, or any system containing client financial data. We do not guarantee specific marketing outcomes — SEO and social media results build over time.

Intellectual property
Content produced for you under an active subscription is licensed to you for use in your business. ProducerPilot retains rights to its underlying templates, processes, and methodologies.

Limitation of liability
To the maximum extent permitted by law, ProducerPilot's total liability for any claim shall not exceed the fees paid by you in the three months prior to the claim.

Governing law
These Terms are governed by the laws of the California in which Accelsure LLC is organized, without regard to conflict of law principles.

Force Majeure
ProducerPilot and Accelsure LLC shall not be held liable for any delay, interruption, or failure to perform any obligation under these Terms of Service or any client service agreement where such delay, interruption, or failure results from causes beyond our reasonable control, including but not limited to:
-
Acts of God, natural disasters, floods, earthquakes, or extreme weather events
-
Pandemic, epidemic, or public health emergency declared by a governmental authority
-
War, terrorism, civil unrest, or government action
-
Internet or telecommunications outages, third-party platform failures, or cyberattacks
-
Changes to third-party platform policies, algorithms, or terms of service (including but not limited to Google, Facebook, LinkedIn, and Instagram) that materially affect service delivery
-
Power outages or failure of essential infrastructure
-
Any other cause beyond the reasonable control of ProducerPilot or Accelsure LLC
In the event of a force majeure occurrence, we will notify affected clients as soon as reasonably practicable and will resume services as promptly as possible once normal conditions are restored. Force majeure events do not entitle either party to terminate the agreement, but if the force majeure condition persists for more than thirty (30) consecutive days, either party may terminate the affected service agreement with written notice, without penalty.
